Terms of Use for Partners
These Terms of Use (“Terms”) describe the services (“Services”) which ForRefugees (“forRefugees”) provides to local grassroots organisations (“Local Partners”), and the obligations of the Local Partner, during application and when using the Services.
ForRefugees is registered with the Charity Commission for England and Wales Number 1168435.
ForRefugees is a no-fee charity aimed at supporting local grassroots non-government organisations (NGOs), largely dependent on volunteers, who are themselves helping refugees on the ground across Europe. ForRefugees provides one off and emergency grants, and basic charity umbrella to suit the individual needs of each Local Partner.
ForRefugees’ services include:

Ownership of the forRefugees’ website and social media platforms including keeping content up-to-date.

Social media can change from time-to-time and includes Facebook, Instagram, LinkedIn, TikTok and YouTube.

User-friendly, easily accessible, online forms for Local Partner applications to register, funds withdrawal and grant requests.

Administering donation platforms including receiving and allocating donations and Gift Aid accurately.

Donation platforms can change from time-to-time and include JustGiving, Facebook, CAF, Global Giving and more.

All Charity Commission and other governance commitments related to forRefugees.
By registering with, and using, the forRefugees’ Services you accept these Terms which may be updated from time to time as could the forRefugees’ website. By continuing to use the Services, you accept the latest published version of these Terms. It is your responsibility to check the latest version.
ForRefugees defines a refugee (“Refugee”) as someone who has been forced to flee his or her country for any reason including persecution, war, natural disaster or economic decline. It includes other terms also used such as displaced people and asylum seekers.
Latest Terms supersede in full all and any previous versions.
1. APPLYING AS A LOCAL PARTNER TO USE THE SERVICES
1.1 To use forRefugees’ Services you must be actively supporting Refugees in Europe.
1.2 You can be (a) an active registered charity/non-profit; (b) an active non-registered charity; (c) an active individual volunteer; or (d) an active group of volunteers.
1.3 There is no limit to the number of Local Partners registered with forRefugees (to be monitored).
1.4 You must complete the forRefugees’ Local Partner Application Form on the forRefugees’ Website including compliance with the declarations which might from time-to-time be updated.
1.5 You agree that we may carry out any checks we consider necessary to verify your identity and confirm the information you provide in your completed registration form is correct. Such checks may be carried out at any time. We reserve the right to change your status with us at any time and at our discretion.
1.6 Acceptance of your Application is at forRefugees’ sole discretion. Once we have accepted your Application we will provide you with Services for three years, unless it is suspended or terminated during that time. At the end of the three years you can re-apply.
1.7 You are responsible for ensuring that all information provided to forRefugees at all times is accurate and complete, and that you keep it up to date for the period you use the Services. You must inform forRefugees of any material developments or changes as a Local Partner which might affect your use of the Services including, but not limited to, any change of purpose, any change in your charity status or if a charity commission (or other governing body) opens an enquiry relating to you/your activities. Particularly in such circumstances forRefugees reserves the right to suspend your Services at any time – immediately and without notice.
1.8 Registered Volunteers authorise forRefugees to use information provided by the Local Partner during Registration and Grant Applications – and from time to time provided for other means – including, but not limited to, logos/brand images, vision and mission statements, website URLs, Facebook links, photos and videos, on the forRefugees website and in other promotional material including social media as applicable in support of the successful delivery of forRefugees day-to-day operation including fundraising.
1.9 You must at all times comply with the requirements of charity law, anti-discrimination, anti-corruption, anti-bribery laws, personal data laws and, if relevant, company law (“Legal Obligations”).
2. REQUESTING GRANTS AND REPORTING DELIVERY
Please refer to the forRefugees’ Grant Policy available on the forRefugees’ website.
3. OPERATION OF THE FORREFUGEES’ WEBSITE
3.1 As a minimum, Local Partner logos will be published on the forRefugees website.
3.2 We reserve the right to decline any donation made to forRefugees, or received by forRefugees on behalf of our Local Partners, at the discretion of forRefugees. E.g. if the donation is coming from a source that we do not feel is aligned to our values.
3.3 Donations can be made in different currencies depending on the donation method. ForRefugees operates and banks in sterling.
4. DATA PROTECTION
4.1 Donations received by forRefugees are often made on a third party donation platform such as CAF Bank or PayPal. Each third party has different processes regarding contact information and our access to those details. The forRefugees’ website does NOT record the name and contact information of visitors or require any donor registration. We do not share donor information with Local Partners without the express consent of the donor. This is an integral part of our privacy offering to donors and compliance to General Data Protection Regulations (GDPR).
4.2 ForRefugees does not add donor information provided for a Local Partner to its own mailing list.
4.3 Minimal personal information will sometimes be requested solely to enable Gift Aid administration and collection from HMRC as appropriate.
4.4 Both parties agree that they act as a Data Controller in respect of any personal data which they process in connection with the provision and receipt of the Services and we both agree to comply with our respective legal data protection obligations. You agree to provide us with help and co-operation as is reasonably necessary or requested by us to enable compliance with any investigation.
5. CONTENT PROVIDED BY YOU
5.1 Any content you submit to us, or which you post on your website or social media, to which there is a link to forRefugees, must not contain illegal material or link to material which is illegal wherever hosted, nor be defamatory, obscene or offensive to others on any grounds.
5.2 If you believe content that is posted by other users on forRefugees’ media is of a defamatory nature email us at [email protected]. If, after investigation, we agree that the content is defamatory we will remove that content as soon as practicable and, in any case, no more than 48 hours after reaching our conclusion.
5.3 You should not publish or link to any material or content for which you do not own the rights without the permission of the owner of the relevant rights.
6. USAGE OF BRANDS & LOGOS
6.1 The name “forRefugees” and the accompanying logo may be used by Local Partners on their own website and social media in relation to their being a Local Partner of forRefugees, or with the aim of increasing traffic to forRefugees’ social media or website.
6.2 Other trademarks, service marks or logos that appear on the forRefugees’ website or social media, in particular (but not exclusively) those of other registered Local Partners, are the property of their respective owners and subject to their restrictions as to their use. We are not in a position to, nor do we assume to, give permission for their use by any other party in any way.
6.3 You permit us to use your name and logo in respect of your participation in the Services including in respect of promotional materials we may publish from time to time.
7. COPYRIGHT
7.1 All content on the forRefugees’ website is owned by forRefugees, Local Partners or other original providers. It is protected by the applicable intellectual property and proprietary rights and laws. You may copy content for your own personal, non-commercial use provided you do not alter or remove any copyright, trade mark, photography credits or other proprietary notice.
8. CHANGES TO THE SERVICE
8.1 We will make every effort to ensure that the Services and the forRefugees website and social media are available continuously. We reserve the right to modify, suspend or discontinue all or any part at any time with or without notice.
8.2 Unless specifically exempted, any new features, services or software applications introduced shall be subject to these Terms.
9. SUSPENSION OF THE SERVICES
9.1 In the event that you (a) commit a breach of these Terms; or (b) if we are made aware, or given reason to suspect, that you or the Services are, or may be, being used for illegal or fraudulent purposes; or (c) any other reason that is brought to our attention that we find concerning, we reserve the right at our sole discretion to immediately and without notice suspend or permanently deny your access to all or part of our Services and to remove your details without notice.
9.2 For the avoidance of doubt, in the event of suspected fraudulent activity we will inform the police and cooperate fully in any investigation.
10. TERMINATION OF THE SERVICES
10.1 Either you or we will have the right to terminate your use of the Services with immediate effect if one of us commits an act of material default under these Terms, if you breach these Terms, or we suspect that you have misused the Services. Where forRefugees terminates your use of the Services, or where you terminate your use of the Services, forRefugees shall not have any liability to you.
10.2 An act of material breach will be considered to have occurred;
10.2.1 If either party becomes insolvent or wound up; or
10.2.2 If (relating to you) we are made aware, or given reason to suspect because of allegations or reports, that your operations as a Local Partner or your use of the Services have any illegal or fraudulent purposes, or would bring forRefugees into reputational disrepute; or
10.2.3 Either party commits an act or threatens to do any act the direct result of which is to damage or is likely to damage the reputation of the other party; or
10.2.4 (Where relevant) your charitable status or your HMRC registration is suspended or withdrawn.
10.3 Either you or we may discontinue your use of the Services at any time and with immediate effect. In this event open Grant requests will be immediately closed un-funded by forRefugees. All Local Partner commitments to provide reporting information to forRefugees’ and our donors relating to previously funded grants must be upheld.
10.4 We reserve the right to withdraw the forRefugees Services from any public access at any time at our complete discretion.
10.5 In the event of termination by you or by us these terms of use will continue to apply past use of the Services.
11. LIMITATION OF LIABILITY
11.1 In no event shall forRefugees be liable for any claims, loss or damage, whether direct or consequential which you claim to have suffered by reason of your accessing the forRefugees’ Services. This expressly includes any Local Partner activities you carry out as a result of receiving a Grant from us.
12. NOTICES
12.1 Notices referred to in these Terms should be made in writing and sent via email. You should send any notices to [email protected] and we will send any Notices to the email address(es) you provided on registration or which you have subsequently updated and we have accepted.
13. DISCLAIMER
13.1 You agree that your use of the forRefugees’ Services is on an “as is” and “as available” basis and that your use of the forRefugees’ Services is at your sole risk. We do not guarantee continuous uninterrupted or secure access to the Services which may be interfered with by numerous factors including factors which are outside of our control.
14. GOVERNING LAW
14.1 These Terms are governed by English Law and are subject to the exclusive jurisdiction of the English courts.
